THE LANDOWNER'S GUIDE TO EASEMENTS AND RIGHT OF WAYS

Railroad, pipeline, telephone, telecommunication, power and other companies are looking for land to use for their purposes. For their projects they need easements and rights of way to install something as benign as a fiber optic cable or something as ominous as a large natural gas or crude oil pipeline on other people's land. If they happen to come your way you need to protect yourself. The Landowner's Guide to Easements and Right of Ways will give you insight into the operations of the large corporations and will enable you to negotiate an easement and right of way most favorable to YOURSELF.

Grant of easement MODIFICATION AND Enhancement
Any standard Grant of Easement may be modified and/or enhanced by adding specific clauses, including Hold Harmless, Limited Liability, Construction Techniques, Limited Facilities, Restoration, Relocation, Reversionary Rights and Most Favored Nation. Actual clauses demonstrate how you can avoid big problems that can develop long after the easement is granted and avoid costly litigation.
Example 1) Grantor retains ownership of the strip of land subject to the easement granted herein, and may continue to use same for any and all purposes which do not interfere with or prevent Grantee's use and enjoyment of the easement rights granted herein.
Example 2) Except to the extent caused by the negligence or willful misconduct of Grantor, or Grantor's tenants, agents or assigns, Grantee agrees to indemnify and hold harmless Grantor and Grantor's heirs, successors and assigns against any claims or losses arising from damage or injury to Grantee's property, employees, agents, or contractors occurring in the course of construction, installation, repair or maintenance of Grantee's facilities upon Grantor's lands. (This clause is just one of several that you will need to use to help limit liability claims against yourself.)
This guide contains many additional clauses covering ingress and egress, repairs, placement of facilities, care of livestock and much more.
